General terms and conditions of the PACK'PRIVILÈGES

The present general terms and conditions of the PACK'PRIVILÈGES (hereinafter referred to as the « Conditions ») constitute the agreement between you and CAMPING-CAR PARK (hereinafter referred to as « CCP » or « We ») with regard to your registration for the PACK'PRIVILÈGES on the campingcarpark.com website (hereinafter referred to as the « CCP Site ») and describe the respective rights and obligations of the parties. Please read the present Conditions carefully.

1. The service

Users of the PACK'PRIVILÈGES can benefit from numerous advantages and services as indicated in these Conditions (together the « PACK'PRIVILÈGES »).

By activating your PACK'PRIVILÈGES, you expressly accept that we begin to provide you with the services associated with the PACK'PRIVILÈGES during the 14-day withdrawal period. 

2. Advantages of the PACK'PRIVILÈGES

2.1 Advantages: the assurance of having a pitch (in advance or at the last minute) 

PACK'PRIVILÈGES holders can reserve a pitch on the areas of the CAMPING-CAR PARK network (stopover areas or Camping de mon Village). The areas eligible for the PACK'PRIVILÈGES are designated as such on their presentation page (via a « I book » or « Sécuriplace » button). The reservation of a stay (from midday to midday) must be made only during the validity period of the PACK'PRIVILÈGES. The PACK'PRIVILÈGES is thus a guarantee of a pitch in the eligible areas.

2.2 Other benefits

The other advantages linked to the PACK'PRIVILÈGES are described on the PACK'PRIVILÈGES page of the CAMPING-CAR PARK website or mobile application. 

3. Subscription

3.1 Activation fees and duration 

The activation fee for the PACK'PRIVILÈGES is indicated on the PACK'PRIVILÈGES page. The next renewal date for your PACK'PRIVILÈGES is indicated in the « My account » section of the CAMPING-CAR PARK website or the application. 

The activation fee for the PACK'PRIVILÈGES is not refundable unless the refund is expressly stipulated in these Conditions. 

3.2 Payment

The activation fees in force at the time will be automatically invoiced if you activate your PACK'PRIVILÈGES and use one of the services even during the withdrawal period. 

The activation fees in force will be automatically invoiced if you activate your PACK'PRIVILÈGES and you do not notify us in writing in compliance with the formalism mentioned in these GTC and before the next renewal date of your wish to cancel the PACK'PRIVILÈGES. 

If your default means of payment is no longer valid during the subscription period of your PACK'PRIVILÈGES or if payment is declined for any reason other than a reason attributable to us, you authorise us to use any other means of payment registered in your customer account. If payment by these forms of payment is declined, you have 30 days to provide us with a new valid method of payment. Otherwise, your subscription to the PACK'PRIVILÈGES will be cancelled. 

3.3 Subscription cancellation by you and refunds 

If you activate your PACK'PRIVILÈGES, you can cancel it each year on the anniversary date by respecting the following rules:

• The PACK'PRIVILÈGES must be cancelled by post addressed to CAMPING-CAR PARK (Service Résiliation PP - 3, rue du Docteur Ange Guépin 44210 Pornic - France) at least 1 month before the renewal date indicated in the « My account » section of the CAMPING-CAR PARK website or application. In this letter, you must indicate the reference number of your PASS'ÉTAPES card as well as your name, first name, postal address and email address. 

You will receive a confirmation email within a week. The information will also be updated in the « My account » section of the CAMPING-CAR PARK website of application as soon as your PACK'PRIVILÈGES has expired. You will no longer benefit from the services of the PACK'PRIVILÈGES when it expires. If you had made a reservation for a date after the validity date of your PACK'PRIVILÈGES, it will be cancelled in case of withdrawal. 

PACK'PRIVILÈGES activations subscribed using a promotional code or a gift card are not refundable. 

3.4 14-day right of retraction 

If you have paid us the activation fee as soon as you subscribed to the PACK'PRIVILÈGES, you can exercise your right of retraction within 14 days after the said activation. If you decide to exercise your right of retraction and you have not benefited from the advantages of the PACK'PRIVILÈGES, we will fully refund the PACK'PRIVILÈGES activation fees to your PASS'ÉTAPES card account. 

To exercise your right of retraction within the 14-day period, you must send a letter (postmarked) to CAMPING-CAR PARK (Service Résiliation PP - 3, rue du Docteur Ange Guépin - 44210 Pornic -France). Please complete and return the following cancellation form:

I hereby give you notice that I withdraw from my contract of sale of the following goods: the PACK'PRIVILÈGES. Here are the details of the order :

The refund will be made to the PASS'ÉTAPES account to which the PACK'PRIVILÈGES was attached. 

3.5 Acceptance of your activation

We reserve the right to accept or reject your activation, to the extent permitted by applicable law. 

3.6 Renewal

As indicated on the PACK'PRIVILÈGES page of the CAMPING-CAR PARK website or application and except in the case of a particular promotional context, the PACK'PRIVILÈGES has an initial validity period of 1 year. 

All the PACK'PRIVILÈGES activated after 14 April 2020 are renewed by tacit agreement on their expiry date for a further year. 

In accordance with the provisions of Article L. 215-1 of the French Consumer Protection Code, CAMPING-CAR PARK informs you by dedicated email at the earliest 3 months and at the latest 1 month before the end of the period authorising the rejection of the renewal, of the possibility of not renewing the PACK'PRIVILÈGES with a tacit renewal clause. As soon as you receive this email, you have a period of 1 month to inform us that you renounce this tacit renewal by post (at the latest 1 month before the end of the PACK'PRIVILÈGES validity period) to CAMPING-CAR PARK (Service Résiliation PP - 3, rue du Docteur Ange Guépin - 44210 Pornic - France). 

3.6.1 Exceptional promotions

COVID-19 solidarity campaign from 30/04/2020 to 18/05/2020

All the PACK’PRIVILEGES bought for 58.00€ on and after the 30th April 2020 – 5 p.m. will be valid for 2 years. After 2 years, they will be renewed by tacit agreement for one more year.

8€ of these 58€ will be donated to the Hospital Foundation of Paris Hospitals of France.

10-year campaign from 23/03/2021 5 p.m. to 19/04/2021 12 p.m.

All the PACK'PRIVILÈGES activated between 23/03/2021 5 p.m. and 19/04/2021 12 p.m. are valid for 14 months instead of 12 months. They are sold at the price of 29€. After these 14 months, they will be renewed by tacit agreement for an additional year. 

3.7 Prohibition on transferring or assigning your activation or your advantages

It is not possible to transfer to third parties your subscription to the PACK'PRIVILÈGES or any advantage resulting from your activation. 

3.8 Prohibition of resale, rental of delivery to customers

You are not allowed to use the PACK'PRIVILÈGES with the aim of booking stays to resell them to third parties. 

3.9 Restrictions relating to minors

The PACK'PRIVILÈGES is reserved for end consumers aged 18 or over. 

4. Termination

We can notify you of the immediate termination of your subscription to the PACK'PRIVILÈGES by right if we consider that (a) your use of the PACK'PRIVILÈGES constitutes a material breach of these Conditions or of any applicable law, or that (b) you make abusive or fraudulent use of the PACK'PRIVILÈGES. You will not receive a refund in this case. We will inform you of the termination of your PACK'PRIVILÈGES and of your right to appeal.

5. Changes in the Conditions

We may at any time make changes to these Conditions or to the PACK'PRIVILÈGES, or to any of its elements: for legal or regulatory reasons, for security reasons; to improve existing elements to the PACK'PRIVILÈGES; to integrate technological advances; to make appropirate technical adjustments to the PACK'PRIVILÈGES; and to ensure that the PACK'PRIVILÈGES functions properly. 

If we make changes, we will inform you of them in the prescribed time and form and remind you of the rights you have. You will have the right not to accept these modifications and will retain the possibility of terminating your subscription to the PACK'PRIVILÈGES at any time.

Any increase in the amount of the subscription fee will not be applied before the end of the current period.

If a modification is considered invalid, null or inapplicable for any reason whatsoever, this does not affect the validity or applicability of the other conditions and modifications. 

6. Amicable claims

Any amicable claim concerning elements figuring on an invoice will be admitted if received within a delay of 90 days from the invoice issue date. Amicable claims must be communicated by e-mail or letter and addressed exclusively to the issuing company. The address of the registered office is stipulated in the header of invoices. Any claim must mention the PASS’ETAPES card number. A claim does not exempt the card holder of their payment obligations relating to the invoice they are contesting. In the case of a claim, the issuing company will carry out an investigation.

Any rectifications following the investigation will be settled at later date. The issuing company will show proof of the transaction(s) by means of records saved in the information system.

We inform you that if you have any reason to contest the present general terms and conditions, it is possible to take recourse to conventional mediation or any other alternative dispute resolution method as set out in the conditions of the 1st title of Book VI of the French consumer code.

After attempting to amicably resolve litigation by filing your claim with the relevant customer services, and in the case of a negative response or the absence of a response within a delay of sixty days (60) of the referral, you may file your claim with the Mediator for Tourism and Travel. The Mediator’s contact details are as follows: Association de Médiation Tourisme et Voyage (MTV) 17 avenue Carnot 75017 PARIS. You can file a claim with the Mediator within a twelve (12) month delay after the first claim was made.

7. Force majeure

We shall not be liable for any delay or failure to perform our obligations under these Conditions if such delay or failure is caused by force majeure. 

8. Applicable law

In addition to seizing a territorially competent court according to the code of civil procedure, the client may choose to seize the legal jurisdiction where they were living at the time when the contract was concluded or when the harmful event occurred. French law shall be solely applicable to this account.
